2. Acknowledgment
By using our Service, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. These Terms also incorporate our Privacy Policy, which outlines how we collect, use, and protect your personal data. Note: My Arc is intended for users 18 years of age and older.
3. Our Intellectual Property
We own or are licensed to use all intellectual property rights in our Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos (collectively, the "Content" and "Marks"). Our Content and Marks are protected by applicable copyright, trademark, and other intellectual property laws.
By using the Services, you may not: (a) download, reverse engineer, decompile, or create derivative works from the Service; (b) sell, resell, sublicense, or distribute the Service; (c) post or transmit unlawful, infringing, or harmful material; (d) interfere with or disrupt the Service or attempt unauthorized access; (e) remove any proprietary notices or labels; (f) use the Service for any unlawful purpose or to impersonate any person or entity.
4. User Contributions
My Arc processes the personal information, inputs, and content you provide solely to generate your personal brand outputs, including your brand statement, career narrative, LinkedIn headline, resume, and cover letter. Your data is not shared with third parties, clients, or other users except as required by the underlying AI service providers necessary to operate the platform.
By submitting content, you represent and warrant that: (a) you own or have the necessary rights to submit such content; (b) your content does not infringe any third-party rights; (c) your content is lawful and accurate. You grant My Arc a limited, non-exclusive license to process your content solely as necessary to provide the Services. We do not claim ownership over your content.
If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use that feedback to improve our Services. We have no obligation to compensate you for feedback.
5. Third-Party Services and AI Processing
My Arc integrates third-party AI services to power its functionality. These services may process your inputs to generate personal brand outputs, resume content, and cover letters. By using our Services, you acknowledge and agree that:
- Certain inputs may be processed by external AI models.
- We do not control how third-party AI services process, store, or use data provided through our platform.
- We take reasonable measures to ensure these services meet industry standards but do not guarantee their accuracy, reliability, or availability.
- The privacy protections in place are consistent with those offered by the underlying AI providers.
AI-generated outputs may contain errors, biases, or inaccuracies. You are solely responsible for evaluating the appropriateness of any AI-generated output before relying on it. We are not liable for any damages arising from the use of such outputs.
6. Passwords and Account Access
To access the Services, you must create an account with accurate and complete information. You are solely responsible for maintaining the security of your account and password. You must notify us immediately of any unauthorized use of your account. My Arc will not be liable for losses caused by unauthorized use of your account.
7. Fees, Payments, and Subscriptions
My Arc offers the following subscription options:
- Standard Plan: $9.99 per month, billed monthly.
- Ambassador Plan: $7.99 per month for the first six months (20% discount), available exclusively through an authorized ambassador promo link. After six months, the subscription renews at $9.99 per month.
By completing a purchase, you authorize BearHug Labs, Inc. to charge your selected payment method. You agree to keep your billing information current and accurate. Sales tax will be added where required by law. All payments are in USD.
Your subscription will automatically renew at the end of each billing period unless you cancel. We may update subscription pricing at any time and will notify you in accordance with applicable law.
All payment transactions are processed securely by Stripe, Inc., a third-party payment processor. My Arc does not store your credit card information on our servers. By completing a purchase, you also agree to Stripe's terms of service and privacy policy, available at stripe.com. Stripe maintains PCI DSS compliance and industry-standard security protocols for all transactions.
8. Cancellation and Refund Policy
All purchases are non-refundable. You may cancel your subscription at any time by logging into your account or contacting us at amanda@arch-collective.com. Upon cancellation, your access to the Services will continue until the end of the current paid billing period. You will not be charged for subsequent periods after cancellation takes effect.
We do not offer free trials. If you have questions or concerns about your subscription, please contact us directly.
9. Services Management
We reserve the right to: (1) monitor the Services for violations of these Terms; (2) take appropriate legal action against users who violate the law or these Terms; (3) restrict, limit, or disable access to any content or contributions at our discretion; (4) remove content that is excessive in size or harmful to our systems; and (5) otherwise manage the Services to protect our rights and ensure proper functioning.
10. Cookies
My Arc uses cookies to enhance your browsing experience in accordance with our Privacy Policy. Cookies enable us to recognize you on each visit and improve website functionality. By using My Arc, you consent to our use of cookies.
11. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy at my-arc.ai/privacy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Services are hosted in the United States. If you access the Services from outside the United States, you consent to the transfer and processing of your data in the United States.
12. Content Liability
We are not responsible for content you post or share through any external platform. You agree to defend and hold us harmless from any claims arising from your content. Links you share should not contain libelous, obscene, or otherwise unlawful material.
13. Reservation of Rights
We reserve the right to request removal of any links to our website and to amend these Terms at any time. By continuing to use our Services after changes take effect, you agree to the revised Terms.
14. Warranties and Limitation of Warranties
The Services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. To the maximum extent permitted by applicable law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted, error-free, or free of viruses or harmful components.
If you are not satisfied with the Services, your sole remedy is to cancel your subscription in accordance with our Cancellation Policy above.
15. Limitations of Liability
IN NO EVENT SHALL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR FOR LOSS OF PROFITS OR DAMAGES ARISING FROM BUSINESS INTERRUPTION OR LOSS OF INFORMATION, INCLUDING IF ANY OF THE FOREGOING ARISES IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES. IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE TOTAL FEES PAID BY YOU DURING THE SIX-MONTH PERIOD PRECEDING THE DATE OF ANY CLAIM.
You agree to indemnify, defend, and hold harmless BearHug Labs, Inc. and its officers, directors, agents, and employees from any losses, expenses, damages, claims, and liabilities, including reasonable attorneys' fees, arising from: (1) your violation of these Terms; (2) activity on your account; (3) your use of the Services; (4) your violation of any third-party right; or (5) your content or data.
16. Digital Millennium Copyright Act (DMCA)
If you believe any content on our Services infringes your copyright, please submit a written notification to our Copyright Agent at amanda@arch-collective.com including: (a) your signature or that of an authorized agent; (b) identification of the copyrighted work; (c) identification of the infringing material; (d) your contact information; (e) a statement of good faith belief; and (f) a statement of accuracy under penalty of perjury.
You acknowledge that disputes arising under the DMCA and these Terms are subject to the jurisdiction of the federal and state courts located in San Francisco, California.
17. Governing Law
These Terms and your use of the Services are governed by the laws of the State of California, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in San Francisco, California for any disputes arising under these Terms.
Any claim or cause of action arising under these Terms must be filed within three months of the date such claim arose. You agree to first attempt to resolve any dispute informally by contacting us at amanda@arch-collective.com.
These Terms constitute the entire agreement between you and My Arc regarding the Services and supersede any prior agreements. If any provision is found invalid, the remaining provisions remain in full force and effect.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes and update the Effective Date at the top of this document. By continuing to use the Services after changes take effect, you agree to the revised Terms.
